Strategies that are effective and legal for putting one’s assets safely out of reach
In today’s increasingly litigious world, the shielding of assets has become a prominent issue for financial planners, business owners, and high-net-worth individuals. Asset Protection details methods that are both legally and morally legitimate for protecting one’s assets from creditors, lawsuits, and scams.
Bringing economic common sense and legitimacy to an area that is drowning in gimmickry, two of today’s top lawyers examine the fundamental issues in this growing area, avoiding dense legalese to make the book accessible to anyone. Asset Protection covers everything readers want to know about:
- Establishing an effective asset protection program
- Today’s most popular, established strategies
- Newer strategies that are still being resolved by the courts

Gerry Spence is perhaps America's most renowned and successful trial lawyer, a man known for his deep convictions and his powerful courtroom presentations when he argues on behalf of ordinary people. Frequently pitted against teams of lawyers thrown against him by major corporate or government interests, he has never lost a criminal case and has not lost a civil jury trial since l969.
In Win Your Case, Spence shares a lifetime of experience teaching you how to win in any arena-the courtroom, the boardroom, the sales call, the salary review, the town council meeting-every venue where a case is to be made against adversaries who oppose the justice you seek. Relying on the successful courtroom methods he has developed over more than half a century, Spence shows both lawyers and laypersons how you can win your cases as he takes you step by step through the elements of a trial-from jury selection, the opening statement, the presentation of witnesses, their cross-examinations, and finally to the closing argument itself.
Spence teaches you how to prepare yourselves for these wars. Then he leads you through the new, cutting-edge methods he uses in discovering the story in which you form the evidence into a compelling narrative, discover the point of view of the decision maker, anticipate and answer the counterarguments, and finally conclude the case with a winning final argument.
To make a winning presentation, you are taught to prepare the power-person (the jury, the judge, the boss, the customer, the board) to hear your case. You are shown that your emotions, and theirs, are the source of your winning. You learn the power of your own fear, of honesty and caring and, yes, of love. You are instructed on how to role-play through the use of the psychodramatic technique, to both discover and tell the story of the case, and, at last, to pull it all together into the winning final argument.
Whether you are presenting your case to a judge, a jury, a boss, a committee, or a customer, Win Your Case is an indispensable guide to success in every walk of life, in and out of the courtroom. -
One Saturday morning in February 1972, an impoundment dam owned by the Pittston Coal Company burst, sending a 130 million gallon, 25 foot tidal wave of water, sludge, and debris crashing into southern West Virginia's Buffalo Creek hollow. It was one of the deadliest floods in U.S. history. 125 people were killed instantly, more than 1,000 were injured, and over 4,000 were suddenly homeless. Instead of accepting the small settlements offered by the coal company's insurance offices, a few hundred of the survivors banded together to sue. This is the story of their triumph over incredible odds and corporate irresponsibility, as told by Gerald M. Stern, who as a young lawyer and took on the case and won.

Gathered from the popular Web site www.StellaAwards.com, The True Stella Awards is an outrageous collection of America’s most ridiculous and frivolous lawsuits.
Named for Stella Liebeck—the woman who spilled hot McDonald’s coffee on herself and then won a lawsuit against the fast-food chain—humorist Randy Cassingham’s popular Web site chronicles the hard-to-believe and amusing claims that have been brought before U.S. courts.
Now, for the first time in book form, The True Stella Awards presents some of the most outlandish and unbelievable-but-true lawsuits in America. Some of the Stella Award cases include:
-The man who legally changed his name to Jack Ass, and then sued MTV for $50 million because their TV show and movie Jackass infringed on his trademark and demeaned his “good name”
-The songwriter who left a minute’s silence on his record only to be sued by the estate of another songwriter who copyrighted his own “silent” song
-The man who sued an amusement park after being the victim of the ultimate "Act of God": he was hit by lightning while standing next to his own car in the parking lot.
“How did [Cassingham] get so popular so fast? Well, for one thing, he writes funny stuff.”

NITA’s best-selling text, Modern Trial Advocacy: Analysis and Practice, has set the standard for trial advocacy texts since 1993. All NITA’s renowned full trial programs use the text, as do prominent law schools nationwide. Steven Lubet guides the beginning advocate from developing a winning case theory through all phases of trial. He explains how to present a case as a story, and how to tell the story to the jury powerfully and persuasively.
Since its initial publication, Lubet significantly enhanced the book in 1997 and now he revises it again to include a new chapter on the most recent revolution in trial advocacy: technology in the courtroom."Electronic Visuals," the new chapter by Edward R. Stein, provides a useful and insightful introduction to technology in the courtroom, ranging from evidentiary issues to practical advice. The new edition also includes updates to Federal Rules 702 and 703.
Modern Trial Advocacy contains separate sections on case theory, witness examination, making the record, and talking to the jury; a comprehensive discussion of case theory explaining how to test and develop alternate trial strategies; a portion of each chapter addressing ethics concerns as they arise in practice; and a unique chapter on persuasion theory describing how the principles of cognitive theory can be used to capture the jury’s imagination.
Modern Trial Advocacy presents a realistic and contemporary approach to learning and developing trial advocacy skills. Lubet writes in a clear, concise style that is attractive to both the beginning advocate and the experienced trial lawyer. And, most importantly, this book offers a sophisticated theory-driven approach to advocacy training that distinguishes it from other books in the field.

The Day the Earth Caved In is an unprecedented and riveting account of the nation’s worst mine fire, beginning on Valentine’s Day, 1981, when twelve-year-old Todd Domboski plunged through the earth in his grandmother’s backyard in Centralia, Pennsylvania. In astonishing detail, award-winning journalist Joan Quigley, the granddaughter of Centralia miners, ushers readers into the dramatic world of the underground blaze——from the media circus and back-room deal-making spawned in the wake of Todd’s sudden disappearance, to the inner lives of every day Centralians who fought a government that wouldn’t listen.
Drawing on interviews with key participants and exclusive new research, Quigley paints unforgettable portraits of Centralia and its residents, from Tom Larkin, the short-order cook and ex-hippie who rallied the activists, to Helen Womer, a bank teller who galvanized the opposition, denying the fire’s existence even as toxic fumes invaded her home. Here, too, we see the failures of major
political and government figures, from Centralia’s congressman, “Dapper” Dan Flood, a former actor who later resigned in the wake of corruption allegations, to James Watt, a former lawyer-lobbyist for the mining industry, who became President Reagan’s controversial interior secretary.
Like Jonathan Harr’s A Civil Action, The Day the Earth Caved In is a seminal investigation of individual rights, corporate privilege, and governmental indifference to the powerless. Exposing facts in prose that reads like fiction, Quigley shows us what happens to a small community when disaster strikes, and what it means to call someplace home.
Praise for The Day the Earth Caved In:
"Her scene-by-scene narrative reads like fiction but inspires outrage in the muckraking tradition of Lincoln Steffens and Rachel Carson.”
—The New York Times
"[A]s a piece of explanatory journalism, The Day The Earth Caved In shines."
—Washington Post Book World
“It is quite a story.”
—The Wall Street Journal
“First rate research and journalism combing to tell a sad, often infuriating tale.” — Kirkus Reviews (starred)
“ Quigley’s riveting account of the nation’s most devastating mine fire will change the way you think about so-called natural disasters, and the emotions we attach to the places we call home. This is an extraordinary book.” — Sean Wilentz, author of The Rise of American Democracy
“Quigley’s tale is a real-life epic of brutally indifferent government, greedy corporations and the unlikely heroes who fight for their basic human rights. It's all here; made in America. You'll feel enraged to know the truth of what happened in our mountains and proud of your fellow Americans who took on Goliath."
— John Passacantando, Executive Director, Greenpeace USA
“If you can imagine a book that combines the gritty dignity of How Green Was My Valley with the muckraking of Silent Spring, then you have some sense of this deeply affecting work.”
— Samuel G. Freedman, author of Upon This Rock
“Joan Quigley, the granddaughter of coal miners, has combined meticulous reporting and personal passion to bring us this important book — one that illuminates an underground blaze that many corporate and government officials sought to smother and conceal.”
— Gay Talese, author of A Writer’s Life
