  • Lies the Government Told You: Myth, Power, and Deception in American History

    Andrew P. Napolitano

Lies the Government Told You: Myth, Power, and Deception in American History

What new crisis will the federal government manufacture in order to acquire more power over individuals? What new lies will it tell?

Throughout our history, the federal government has lied to send our children off to war, lied to take our money, lied to steal our property, lied to gain our trust, and lied to enhance its power over us. Not only does the government lie to us, we lie to ourselves. We won't admit that each time we let the government get away with misleading us, we are allowing it to increase in size and power and decrease our personal liberty.

In acquiescing to the government's continuous fraudulent behavior, we bear partial responsibility for the erosion of our individual liberties and the ever-expanding federal regulation of private behavior. This book attacks the culture in government that facilitates lying, and it challenges readers to recognize that culture, to confront it, and to be rid of it.

  • Supreme Power: Franklin Roosevelt vs. the Supreme Court

    Jeff Shesol

Supreme Power: Franklin Roosevelt vs. the Supreme Court
In the years before World War II, Franklin Roosevelt's fiercest, most unyielding opponent was neither a foreign power nor "fear itself." It was the U.S. Supreme Court.

Beginning in 1935, in a series of devastating decisions, the Supreme Court’s conservative majority left much of FDR’s agenda in ruins. The pillars of the New Deal fell in short succession. It was not just the New Deal, but democracy itself, that stood on trial. In February 1937, Roosevelt struck back with an audacious plan to expand the Court to fifteen justices—and to “pack” the new seats with liberals who shared his belief in a “living” Constitution.

The ensuing fight was a firestorm that engulfed the White House, the Court, Congress, and the nation. The final verdict was a shock. It dealt FDR the biggest setback of his political life, split the Democratic party, and set the stage for a future era of Republican dominance. Yet the battle also transformed America’s political and constitutional landscape, hastening the nation’s march into the modern world.

This brilliant work of history unfolds like a thriller, with vivid characters and unexpected twists. Providing new evidence and fresh insight, Jeff Shesol shows why understanding the Court fight is essential to understanding the presidency, personality, and legacy of FDR—and to understanding America at a crossroads in its history.

    Andrew P. Napolitano

Constitutional Chaos: What Happens When the Government Breaks Its Own Laws

    • shoot holes in the Second

    • imprison without charge
    • kill without cause

Pundits on the right, left, and center have praised Constitutional Chaos for its penetrating examination of our rights and liberties in the post-9/11 world.

"Has the war on terrorism taken away some of your rights? In a non-ideological way, Judge Andrew P. Napolitano answers that crucial question. This book will open your eyes."-Bill O'Reilly

"This book is a wake-up call for all who value personal freedom and limited government."-Rush Limbaugh

  • The Constitution in Exile: How the Federal Government Has Seized Power by Rewriting the Supreme Law of the Land

    Andrew P. Napolitano

The Constitution in Exile: How the Federal Government Has Seized Power by Rewriting the Supreme Law of the Land

What ever happened to our inalienable rights?

The Constitution was once the bedrock of our country, an unpretentious parchment that boldly established the God-given rights and freedoms of America. Today that parchment has been shred to ribbons, explains Fox News senior judicial analyst Judge Andrew P. Napolitano, as the federal government trounces state and individual rights and expands its reach far beyond what the Framers intended.

An important follow-up to Judge Napolitano's best-selling Constitutional Chaos, this book shows with no-nonsense clarity how Congress has "purchased" regulations by bribing states and explains how the Supreme Court has devised historically inaccurate, logically inconsistent, and even laughable justifications to approve what Congress has done.

It's an exciting excursion into the dark corners of the law, showing how do-gooders, busybodies, and control freaks in government disregard the limitations imposed upon Congress by the Constitution and enact laws, illegal and unnatural, in virtually every area of human endeavor.

Praise for The Constitution in Exile from Left, Right, and Center

"Does anyone understand the vision of America's founding fathers? The courts and Congress apparently don't have a clue. But Judge Andrew P. Napolitano does, and so will you, if you read The Constitution in Exile."-BILL O'REILLY

"Whatever happened to states rights, limited government, and natural law? Judge Napolitano, in his own inimitable style, takes us on a fascinating tour of the destruction of constitutional government. If you want to know how the federal government got so big and fat, read this book. Agree or disagree, this book will make you think."-SEAN HANNITY

"In all of the American media, Judge Andrew P. Napolitano is the most persistent, uncompromising guardian of both the letter and the spirit of the Constitution, very much including the Bill of Rights. Increasingly, our Constitution is in clear and present danger. Judge Napolitano--in The Constitution in Exile--has challenged all Americans across party lines to learn the extent of this constitutional crisis." -NAT HENTOFF

"Judge Napolitano engages here in what I do every day on my program-make you think. There's no question that potential Supreme Court nominees and what our Constitution says and doesn't say played a major role for many voters in our last couple of elections. What the judge does here is detail why the federal government claims it can regulate as well as tax everything in sight as it grows and grows. Agree or disagree with him-you need to read his latest book, think, and begin to arm yourself as you enter this important debate." -RUSH LIMBAUGH

"At a time when we are, in Benjamin Franklin's words, sacrificing essential liberty to purchase a little temporary safety, here comes the judge with what should be mandatory reading for the executive branch cronies who are busy stealing power while they think we're not watching. Thank goodness the judge is watching and speaking truth to power. More than a book, this is an emergency call to philosophical arms, one we must heed before it's too late." -ALAN COLMES

  • The Law

    Frederic Bastiat

    The Law
In The Law, Bastiat states that "each of us has a natural right - from God - to defend his person, his liberty, and his property". The State is a "substitution of a common force for individual forces" to defend this right. The law becomes perverted when it punishes one's right to self-defense in favor of another's acquired right to plunder.
Bastiat defines two forms of plunder: "stupid greed and false philanthropy". Stupid greed is "protective tariffs, subsidies, guaranteed profits" and false philanthropy is "guaranteed jobs, relief and welfare schemes, public education, progressive taxation, free credit, and public works". Monopolism and Socialism are legalized plunder which Bastiat emphasizes is legal but not legitimate.

  • We Still Hold These Truths: Rediscovering Our Principles, Reclaiming Our Future

    Matthew Spalding

We Still Hold These Truths: Rediscovering Our Principles, Reclaiming Our Future
At a time when economic crisis, ever-expanding government, rising international threats, declining civic education, and many other problems cloud America's future, political leaders increasingly pay lip service to 'first principles' - the principles on which the nation was founded. But just what are those principles? On that question, sadly, politicians and pundits have little to say. Fortunately, Matthew Spalding provides the answer in "We Still Hold These Truths". Spalding, an expert in American political history at The Heritage Foundation, the esteemed Washington, D.C. - based research and educational institute, explains and brings to life ten core principles that define our national creed and common identity. His enlightening and entertaining tour through American history recalls our first principles as they were understood by the Founders and reveals their deep roots in Western civilization. But "We Still Hold These Truths" is more than an inspiring account of the nobility of America's accomplishments. It is also a bracing reminder of how far we have strayed off course as a nation. Spalding shows how readily political leaders and cultural elites abandon - indeed, trample on - the principles to which this country is dedicated. Even more troubling is how readily we all let it happen. Before we can rededicate ourselves to the core principles that made America, we must rediscover them. For as Thomas Jefferson observed, 'If a nation expects to be ignorant and free in a state of civilization, it expects what never was and never will be'. Appreciating our vital heritage, Spalding lays out a strategy to reclaim our future - getting our nation back on track and holding accountable those who seek to take us in a different direction.

  • Dred Scott's Revenge: A Legal History of Race and Freedom in America

    Andrew P. Napolitano

Dred Scott's Revenge: A Legal History of Race and Freedom in America

Judge Andrew Napolitano lays bare the twisted legal history of racism in America.

"All men are created equal and endowed by their Creator with certain inalienable rights" wedded the American soul to the concept that freedom comes from our humanity, not from the government. But American governments legally suspended the free will of blacks for 150 years, and then denied blacks equal protection of the law for another 150 years. How did this happen in America, how were the Constitution and laws of the land twisted so as to institutionalize racism, and how did it or will it end? In a refreshingly candid book, Dred Scott's Revenge: A Legal History of Race and Freedom In America, Judge Andrew P. Napolitano takes a no-holds-barred look at the role of the government in the denial of freedoms based on race.

    Endorsements

"The best history of the law and race I've ever read. . . Judge Napolitano has written a challenge to anyone who thinks they understand the roots of America's tangled race relations." -- Juan Williams, National Public Radio

"The Attorney General ignited a firestorm by suggesting that ours was a nation of 'cowards' when it comes to conversations about race. Judge Andrew Napolitano is no coward. His brave and incisive book takes the calamitous, contemptuous Dred Scott decision, which held slaves to be "non-persons," as its starting point. In this sharply written narrative, the Judge shows us how race remains the driving force in almost every aspect of American life, from education to law enforcement. Dred Scott, the person, would have appreciated this graphic and honest appraisal." -- Geraldo Rivera, Fox News Channel

"Judge Napolitano . . . has written a riveting guide to the tumultuous history of our civil rights journey, coming to a post-racial society." -- Nat Hentoff, Reporters Committee for Freedom of the Press, senior fellow at the Cato Institute

"Dred Scott's Revenge makes it impossible for the self-anointed 'experts' on race relations to ever accuse the country of being too afraid to have a national discussion on race. Judge Napolitano lays out 150 years of our national experience . . . and places the blame for much of what's wrong squarely at the feet of those responsible: the federal government and politicians whose plans, policies, and programs trashed the Constitution. Compelling and timely reading written for the layman, not lawyers!" -- Glenn Beck, Nationally syndicated radio talk show host; Host, The Glenn Beck Program, Fox News Channel

"It is said President Obama gave the definitive speech on race; well, Judge Andrew Napolitano has written the definitive book. [He] has broken new ground as he examines the precious link between the words men write about freedom and the true freedom of all men." -- Gov. Michael Steele, Chair, Republican National Committee

  • From Disgust to Humanity: Sexual Orientation and Constitutional Law (Inalienable Rights)

    Martha C. Nussbaum

From Disgust to Humanity: Sexual Orientation and Constitutional Law (Inalienable Rights)
A distinguished professor of law and philosophy at the University of Chicago, a prolific writer and award-winning thinker, Martha Nussbaum stands as one of our foremost authorities on law, justice, freedom, morality, and emotion. In From Disgust to Humanity, Nussbaum aims her considerable intellectual firepower at the bulwark of opposition to gay equality: the politics of disgust.

Nussbaum argues that disgust has long been among the fundamental motivations of those who are fighting for legal discrimination against lesbian and gay citizens. When confronted with same-sex acts and relationships, she writes, they experience "a deep aversion akin to that inspired by bodily wastes, slimy insects, and spoiled food--and then cite that very reaction to justify a range of legal restrictions, from sodomy laws to bans on same-sex marriage." Leon Kass, former head of President Bush's President's Council on Bioethics, even argues that this repugnance has an inherent "wisdom," steering us away from destructive choices. Nussbaum believes that the politics of disgust must be confronted directly, for it contradicts the basic principle of the equality of all citizens under the law. "It says that the mere fact that you happen to make me want to vomit is reason enough for me to treat you as a social pariah, denying you some of your most basic entitlements as a citizen." In its place she offers a "politics of humanity," based not merely on respect, but something akin to love, an uplifting imaginative engagement with others, an active effort to see the world from their perspectives, as fellow human beings. Combining rigorous analysis of the leading constitutional cases with philosophical reflection about underlying concepts of privacy, respect, discrimination, and liberty, Nussbaum discusses issues ranging from non-discrimination and same-sex marriage to "public sex." Recent landmark decisions suggest that the views of state and federal courts are shifting toward a humanity-centered vision, and Nussbaum's powerful arguments will undoubtedly advance that cause.

Incisive, rigorous, and deeply humane, From Disgust to Humanity is a stunning contribution to Oxford's distinguished Inalienable Rights series.

  • Crisis and Command: A History of Executive Power from George Washington to George W. Bush

    John Yoo

Crisis and Command: A History of Executive Power from George Washington to George W. Bush
An American President faces war and finds himself hamstrung by a Congress that will not act. To protect national security, he invokes his powers as Commander-in-Chief and orders actions that seem to violate laws enacted by Congress. He is excoriated for usurping dictatorial powers, placing himself above the law, and threatening to “breakdown constitutional safeguards.”

One could be forgiven for thinking that the above describes former President George W. Bush. Yet these particular attacks on presidential power were leveled against Franklin D. Roosevelt. They could just as well describe similar attacks leveled against George Washington, Thomas Jefferson, Andrew Jackson, Abraham Lincoln and a number of other presidents challenged with leading the nation through times of national crisis.

However bitter, complex, and urgent today’s controversies over executive power may be, John Yoo reminds us they are nothing new. In Crisis and Command, he explores a factor too little consulted in current debates: the past. Through shrewd and lucid analysis, he shows how the bold decisions made by Washington, Jefferson, Jackson, Lincoln, and FDR changed more than just history; they also transformed the role of the American president. The link between the vigorous exercise of executive power and presidential greatness, Yoo argues, is both significant and misunderstood. He makes the case that the founding fathers deliberately left the Constitution vague on the limits of presidential authority, drawing on history to demonstrate the benefi ts to the nation of a strong executive office.
